Amber Heard has formally filed an appeal against the judgement in her ex-husband Johnny Depp’s defamation lawsuit.
The previous trial had a lot of flaws, according to Heard’s legal team. These include the trial’s location, how the jury was informed about portions of the trial, and Heard’s refusal to include proof from a November 2020 case in the UK that described her ex as a “wife abuser.”
One point Heard’s legal team has raised is that they feel Depp’s legal team failed to establish Heard used “actual malice,” and they failed to explain the word to the jury. Actual malice occurs when someone makes a remark about another individual with complete disrespect for what they believe to be true.
Depp first sued Heard after she penned an op-ed about being a victim of physical assault in 2018. Heard never mentioned Depp in her article.
Following the pair’s 2022 trial, Depp was granted $10 million in compensatory damages and $5 million in punitive penalties.
Heard filed in Virginia on November 23, 2022. Representatives for Heard and Depp have yet to comment on the report.
