Kevin Costner now wants his former wife, Christine, to pay his legal bills for the prenuptial agreement dispute.
According to court records on Monday, the actor/director, 68, is demanding that Christine, 49, pay his legal expenses of $99,225. (A court date has been scheduled on August 2.)
According to the terms of their prenup, if either party employed counsel to enforce or avoid a breach of the agreement, “the prevailing party… shall be entitled… to be reimbursed by the non-prevailing party for all costs and expenses incurred thereby.”
Costner’s motion also respectfully reminded the court that, as part of the prenup, he put aside $1.5 million in a bank account for Christine—assets she has indicated she does not want to access in order to endanger her legal standing in the divorce.
Christine, a former handbag designer who is now out of work, and her legal team noted in a prior filing that due to the vast difference in resources available to the parties, Christine is also requesting that Kevin advance an additional $350,000 in attorney’s fees and $150,000 in forensic costs.
Her July 5 lawsuit also included Costner’s request that she pay his legal bills.
Kevin contends that he should not be required to pay fees and costs in order for Christine to contest the validity of the PMA [pre-marital agreement]. He also often asserts that the PMA is genuine and that no proof to the contrary exists. This is the equivalent of whistling past a cemetery.
But Kevin’s focus on the PMA at this point is premature and totally irrelevant to Christine’s RFO for child support and fees, they said. The fees and expenses will be enormous, as the Court can see from the pleadings at this early point, since Kevin’s finances are complicated, and also as Kevin is doing all he can to reduce his duty to his kids.
Christine had previously requested $248,000 in child support for their three children, Cayden, 16, Hayes, 14, and Grace, 13. She said the sum was still “less than the amount needed to maintain the children in their accustomed lifestyle,” and she also requested that Costner pay their private-school tuition, extracurricular activities and sports charges, and health-care expenses.
Christine’s request was deemed extremely inflated and unsubstantiated by Costner, who said that giving minor kids more than the essentials does not require providing ludicrous extravagance designed to primarily help the supported parent.
A decade after Costner allegedly paid ex-wife Cindy Silva $80 million in his first divorce, the pair married in 2004 with a prenup in place. Christine filed for divorce on May 1, stating that they separated on April 11.
